These Terms of Use and Privacy Policy govern your use of the JM CYBER SPACE IT Support Portal ("the Portal") operated by JM CYBER SPACE (Pty) Ltd, a company registered in South Africa ("we", "us", or "JM CYBER SPACE"). By registering and using the Portal you agree to these terms.
1. Terms of Use
1.1 Authorised Use. The Portal is provided exclusively to clients, technicians, and staff of JM CYBER SPACE for the purpose of logging, tracking, and managing IT support requests. Unauthorised access is prohibited.
1.2 Account Responsibility. You are responsible for maintaining the confidentiality of your login credentials. You must not share your account with any third party. You must notify us immediately of any unauthorised access to your account.
1.3 Acceptable Use. You agree not to: submit false or misleading support tickets; attempt to access other users' data; use the Portal for any unlawful purpose; upload malicious files or software; or attempt to reverse-engineer or compromise the Portal's security.
1.4 Service Availability. We strive to maintain 99% uptime but do not guarantee uninterrupted access. Scheduled maintenance will be communicated where possible.
1.5 Intellectual Property. All content, design, and functionality of the Portal is the intellectual property of JM CYBER SPACE. You may not reproduce or distribute any part of the Portal without written consent.
1.6 Termination. We reserve the right to suspend or terminate your account if you breach these terms, without prior notice.
2. Privacy Policy — POPIA Compliance
This Privacy Policy is drafted in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA), which came into full effect on 1 July 2021 in South Africa.
2.1 Who We Are (Responsible Party)

The Information Officer responsible for POPIA compliance is the Director of JM CYBER SPACE.
2.2 Personal Information We Collect
We collect only the minimum personal information necessary to provide IT support services:
- Identity data: Full name
- Contact data: Email address, phone number
- Business data: Company name, business address
- Device data: Device names, IP addresses, operating systems, remote access IDs (RustDesk)
- Support data: Details of IT issues submitted via support tickets, including any files or screenshots you upload
- Usage data: Login timestamps, audit activity within the Portal
- Billing data: Invoice records and payment status (we do not store banking or card details)
2.3 Lawful Basis for Processing
In terms of POPIA, we process your personal information on the following lawful bases: (a) Contract — to fulfil our IT support service agreement with you; (b) Consent — which you provide when registering on the Portal; (c) Legitimate interest — to maintain security, prevent fraud, and improve our services; and (d) Legal obligation — to comply with applicable South African law.
2.4 How We Use Your Information
Your personal information is used exclusively to:
- Create and manage your support portal account
- Process, assign, and resolve IT support tickets
- Facilitate remote support sessions (with your consent)
- Issue invoices and manage billing
- Communicate updates about your support requests
- Maintain security and prevent unauthorised access
- Comply with legal obligations
We will never sell, rent, or share your personal information with third parties for marketing purposes.
2.5 Third-Party Processors
We use the following third-party services to operate the Portal. Each is bound by data processing agreements and complies with international data protection standards:
- Supabase Inc. (USA) — Database hosting and authentication. Data may be stored on servers outside South Africa. Supabase is SOC 2 Type II certified and provides adequate protection as required by POPIA Section 72.
- RustDesk — Remote desktop software used only when you request remote support and only with your explicit consent during a support session.
2.6 Data Security
We implement appropriate technical and organisational measures to protect your personal information, including: encrypted data transmission (HTTPS/TLS); password hashing using bcrypt; row-level security policies restricting data access; session management and automatic timeouts; and regular security reviews. Despite these measures, no system is completely secure. In the event of a data breach affecting your rights, we will notify you and the South African Information Regulator as required by POPIA.
2.7 Data Retention
We retain your personal information for as long as your account is active or as required to provide services. Support ticket records are retained for 3 years for service history and warranty purposes. Billing records are retained for 5 years in accordance with South African tax law. You may request deletion of your account at any time (see Section 2.8).
2.8 Your Rights Under POPIA
As a data subject under POPIA, you have the following rights:
- Right to be informed — to know what personal information we hold about you
- Right of access — to request a copy of your personal information
- Right to correction — to request correction of inaccurate information
- Right to deletion — to request deletion of your personal information (subject to legal retention obligations)
- Right to object — to object to processing of your personal information
- Right to withdraw consent — to withdraw consent at any time (this will not affect processing already done)
- Right to complain — to lodge a complaint with the South African Information Regulator at inforeg.org.za

2.9 Cookies
The Portal uses session storage for authentication only. We do not use advertising cookies or track your activity across other websites.

4. Changes to This Policy
We may update these terms periodically. Material changes will be notified via the Portal. Continued use of the Portal after changes constitutes acceptance of the updated terms.
